Probate is the process for the after death court approval of a last will and testament (or declaration that the deceased died without a will). The court will first, identify the heirs and appoint the personal representative, then second, extend that personal representative the power and authority to deal with the deceased’s property. Third, the personal representative will distribute the property to the heirs after dealing with creditor claims, and finally file all necessary tax returns. Will based estate plans often require probate while revocable living trust based plans seldom require probate. We have extensive experience with probates large and small, contested and uncontested.
